DELIVERY TIMES

While we try to provide delivery times that are as accurate as possible, sometimes manufacturing and other delays occur which are beyond our control. We undertake to advise you when such delays do occur, as soon as we are advised.

CONDITIONS OF SALE

All goods must be paid before delivery in cash or other acceptable payment unless prior arrangements have been made with Hatch Home. Delivery of goods does not include installation or assembly. If required, installation and assembly of goods should be pre-arranged and additional charges will apply. You should examine all goods on or as soon as possible after delivery. Any faulty, defective or damaged goods should be immediately reported to Hatch Home.

Title to goods will pass on payment for the goods in full to Hatch Home. Risk will pass on delivery to the delivery address specified. Hatch Home may recover expenses, costs or disbursements incurred in recovering any outstanding payments including debt collection agency fees and solicitor's costs.


LAY-BYS

A deposit of 30% of the sale price must be paid for goods purchased by lay-by. Goods must be collected and paid for in full within 3 months (or such other period as is agreed in writing), failing which Hatch Home may, after providing you with 14 days notice to the address on this invoice cancel the lay-by and retain a cancellation fee which will be an amount equal to 30% of the sale price. If you cancel the lay-by, Hatch Home will refund (by the same method as the original payment) all monies paid less the cancellation fee, which will be an amount equal to 30% of the sale price, within 14 days.

 

SPECIAL ORDERS

A deposit of 30% of the sale price must be paid for Special Order goods. Special Order goods must be collected and paid for in full within 1 month of receiving notice from Hatch Home that the goods are available for delivery (or such other period as is agreed in writing), failing which Hatch Home may, after providing you with 14 days notice to the address on this invoice, cancel the Special Order and retain a cancellation fee which will be an amount equal to 30% of the sale price.

Please note that we do not accept returns for any change of mind on special orders. Once a special order is placed, it is final. We encourage our customers to review their orders carefully before completing the purchase to ensure it meets their needs and expectations. Our policy is designed to maintain the high standards of our bespoke services and ensure that every product is crafted with the utmost care and precision.


PRODUCT WARRANTY

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

In addition to the minimum conditions or warranties expressed or implied by the Australian Consumer Law relating to the sale of products of this kind in Australia, the Hatch Home store specified on the tax invoice provides the following additional warranty in support of the furniture products specified on the tax invoice supplied by the relevant Hatch Home store within Australia.

 

12 MONTH WARRANTY AGAINST DEFECTS IN MATERIALS AND WORKMANSHIP

The relevant Hatch Home store warrants that, subject to the terms and conditions of this warranty set out in this document, for a period of 12 months from the date of supply of the Product to the party who purchased the Product from Hatch Home:

_ The Product will be free from defects in materials and workmanship and fit for its intended purpose; and

_ If the Product has deteriorated due to defects in materials and/or workmanship it will be replaced or repaired without cost to you or you will be refunded the price you paid for the Product.

 

EXCLUSIONS AND LIMITATIONS

This warranty is not transferable to any subsequent owner of the Product.

This warranty does not cover the cost of claiming under the warranty or freight costs.

This warranty will be void where:

the Product has been subjected to misuse, negligence or accident by you or any third party; or the Product has been modified, repaired or altered by you or any third party.

Hatch Home will not be liable under this warranty for any damages, losses, costs or expenses including, without limitation, loss of  market, loss of profit, loss of production or for any financial or economic loss including indirect or consequential loss or damage which may be suffered by you or by any third party arising out of or in any way connected with failure of the Product or any defect in materials and workmanship except as provided by this warranty.

The obligations of the relevant Hatch Home store under this warranty will be limited to one of the following at the election of the Hatch Home store:

repair of the Product; or

_ Provision of a replacement Product or, where this is not possible for any reason, the provision of an equivalent product; or

_ A refund of the price you paid for the product.

_ Not withstanding any other provision of this warranty, Hatch Home's liability arising from, under or in connection with this warranty will be limited to the full replacement value of the Product.

You acknowledge that Hatch Home is not the manufacturer of the Product. To the extent permitted by law, Hatch Home shall not be liable as the manufacturer of the Product.

This warranty is only valid and enforceable in Australia.

 

HOW TO CLAIM

To make a claim under this warranty you should promptly contact the Hatch Home store that you purchased the Product from or call the store upon discovery of any defect in the Product or any problem that indicates that the Product may not be fit for its intended purpose.

You must promptly return the Product together with your proof of purchase to the Hatch Home store to allow the store to inspect the Product and fulfil its obligations under this warranty.

The Hatch Home store and/or its representative shall have a reasonable time to repair, replace or refund you in respect of any Product that Hatch Home in its sole discretion considers is not fit for its intended purpose or exhibits a defect in materials and/or workmanship.

By making a claim, you agree to accept the terms and conditions of this warranty.
